ITEK IMAGING LTD. – WARRANTY, GUARANTEE & RETURN POLICY

1 – YEAR LIMITED WARRANTY

Itek Imaging Ltd. (“Itek”) offers a one (1) year limited warranty from the date of purchase for any product, accessory, parts or supplies (hereinafter an “Itek Product”) purchased from directly from Itek.

Eligible Itek Products

This Limited Warranty applies only to Itek Products used by the individual or company who originally purchased the Itek Product (herein after the “Original Purchaser”). This Limited Warranty will terminate immediately upon the Itek Product being rented, sold, or otherwise disposed of by the Original Purchaser to a third party.

This Limited Warranty does not apply to any Itek Product that has been damaged by accident, neglect, misuse. Misuse includes, but is not limited to, improper installation, handling, storage, transport or operation of the Itek Product; this further includes service, maintenance, modifications, or tampering to the Itek Product by anyone other than an authorized Itek representative.

Limited Liability

Neither Itek nor anyone else involved in the development, production, or delivery of any Itek Product shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, arising from the use of or inability to use the Itek Product, even if advised of the possibility of such damages prior to purchase of the Itek Product.

Entire Warranty

This Limited Warranty states Itek’s entire liability and your exclusive remedy against Itek for any failure of the Itek product to operate properly. No oral or written information, advice or representation provided by any Itek agent or employee, shall create another warranty or modify this Limited Warranty.

ITEK DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATIONS, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE EXCEPT TO THE EXTENT THAT ANY WARRANTIES IMPLIED BY LAW CANNOT BE VALIDLY WAIVED.

Governing Law

Any disputes with regards to the validity or applicability of this Limited Warranty shall be governed under the laws of the Province of Ontario.

Pursuant to the one (1) year limited warranty (the “Limited Warranty”), Itek will provide a refund or will replace any Itek Product with, at Itek’s sole discretion, a new, refurbished, or compatible Itek Product free of charge if you are unsatisfied with your Itek Product, or if the shelf-life of your Itek Product is less than one (1) year from the date of purchase. For the purpose of this Limited Warranty, “shelf – life” shall mean the period of time where an Itek Product, in its original and unopened packaging, stored indoors, under normal office temperatures and storage conditions, is expected to function as it would on the date of purchase.
